Others This is regarding relieving of officers / executives from hard tenure circles/ stations on completion of tenure a reminder of letter from director hr Dt. 27.07.2016 after the sad desmise of Sde sh. Maheswar das under depression due to delay in his transfer orders from tenure circles . Director Hr herself has asked that such officials must be relieved without waiting for substitute. But j&k circle has not given any ear to her request and thus creating similar depression in the executives working here . Does Administrators are waiting for something to happen and then react . It is hard to understand such attitude . This is therefore utmost request that such things must be avoided . An early action is required please Regards grieved executives from j&k circle1

Policy Comrade SDE RR modification wef 2002/1996 is a burning issue pl takeup this issue seriousy with management/DOT.In my openion this is simply a clerical mistake happened during SDE RR modification on 1996 and also BSNL has modify SDE RR wef 2002 simply copying DOT SDE RR 1996.in SDE RR 1981 rota/quotq provision is clear but in SDE RR 1966 only 75% and 25% provision is mentioned.R/Comrade if DOT/BSNL corrects its mistake then there should not be any problem in VY based seniority.Every this is possible.1

Organisational Sir, Regarding EPS option to DRs i want to share some points. Actually EPF has given option to us to choose between Provident fund and pension. If we want pension we have to lose provident fund because the amount diverted to EPS is non returnable. I have calculated the amount until now i.e. 10 years around 5lakh and from now on onwards 5400 monthly and 8% interest total amount which will be with EPS is around 84LAKH on at 2041i.e my retirement year. In actual scenario if basic and DA increase the amount will be much more if it is in provident fund. I guess it around 1.25 CRORES. This amount is non returnable to me at the time of retirement but they will give me pension on my full basic. It is useful to me if i live long after retirement may be more than 20 Years. Hence i request everybody pls calculate it then only give option for full pension. If i keep it in provident fund i will get 1.25 Crores and without tax and it will be useful to our family. If SAB 30 % in true spirit implemented means we will get pension without losing provident fund. Hence i request you to give more focus on finalization of forming of SAB trust rules as early possible. Present option is not a relief, rather it created lot of confusion which one choose. If SAB 30 % is implemented, then only we i.e DRs will get relief.0

Others Dear sir, This is regarding FR 22 1 A 1 of officiating JTOs. Corporate office saying in the letter dated 22-12-2015, FR 22 1 a 1 is to be implemented upto 31-12-2006 only. Others MTNL & BSNL merger is coming rounds. MTNL people are on standard pay scale where there is no E1A and E2A. Now, when MTNLians opt to join BSNL, they are offered BSNL Scales. What is this? Does this means, non-standard pay scales are having the sanctity from DoT? Further, MTNLians are now having Rule-37A with Govt Pension. News are coming out that MTNLians who do not want to join BSNL can opt for VRS with 2 increment for every left out year service. BSNL optees and Association must demand implementing standard IDA pay scales before taking any decision on MTNL merger and also similar VRS in merger on same terms and on par with them. Loss amassed by MTNL is not going to be borne by BSNL it seems. This means BSNLians and Associations must demand similar terms in merger of both entities for BSNLians also. This is the good chance for us also.0

Policy The proposal for amendments in SDE- RR regarding the inter-se seniority to be applicable from the vacancy year 2009-2010 onwards has already been approved by Management Committee, but awaiting the approval of BSNL Board. It has been conveyed by BSNL in writing on dated 21.09.2016 in Hon’ble CAT Chandigarh bench that the proposal is likely to be approved by BSNL board in three months’ time. Therefore it requested to kindly convince the management to modify SDE RR wef 2002 not from 2009 so that all the seniority related cases pending id different courts will be resolved. .0

Organisational Sir, I was working as SDE Officiating from 2003. But my pay was not protected when I was promoted on regular basis in 2009. Even my pay was recovered. Sir my officiating promotion was as per RR (SCF). I had three charges of SDE, I have delivered my all duties without fail as a SDE in the interest of BSNL for continues six years. As my duty as SDE was continued till regular promotion, my pay could have protected. But on the contrary Nagpur SSA has recovered and reduced my pay. Sir when department was in need they have promoted as per RR and BSNL was definitely benefited with our timely devoted services then whats wrong in giving pay protection to us ?. Policy Dear friends The JTO’s in BSNL working since 15 years or more are disappointing and a mum is seen in our group. Then I want to create interest among our members and posted some proposals regarding CPSU cader hierarchy. For this I have recollected the experiences faced by my senior colleagues regarding injustice happened to them compared to their juniors in pay commission. They were telling that in every pay commission juniors will be benefited. To counter this injustice government introduced bunching of increments for seniors and gave extra increments in the 5th pay commission. This matter of compensation to seniors made me to think and draft some useful points in our promotional policy to compensate injustice happened to senior executives. I have named this proposal as 8-4-2-1 approach method for functional Promotions. The main postulates of my proposals are as under: 1. For every cadre there must be fixed residency period say 5 years. The service rendered above this period will be counted for future promotions and so on. 2. This scheme should be effective from 1-10-2000. 3. Service above residency Period will be calculated as under 8years JTO Service= 4years SDE service=2years Sr.SDE Service =1year DE service. That is why it is named as 8421 method. 4. There will not be any deviation in time bound promotions. (they should run parallel) 5. Year of recruitment should be criterion for deciding the seniority of excecutives. 6. The duties of SDE and Sr. SDE should be same. 7. The seniority/ gradation list should be reviewed every year. I am mentioning some examples of positions for some of executives below to give clear picture about this method: Ex1. A JTO with 17 years’ service should be placed as given below: Total service as JTO is 17 years Extra service rendered in the cadre is 17-5=12 yrs. So this service is equivalent to 12/2=6yrs SDE service. But SDE residency period is 5 years only. Hence he completes 1 year extra as SDE and gets half year service advantage in Sr.SDE cadre. After 4 and half years he will be DE. Ex2. Executive with 13 years as JTO and 3 years as SDE Here the extra service rendered as JTO is 13-5=8years i.e equivalent to 4 years as SDE. Total effective SDE service will be 3+4=7 years. As he exceeded the residency service as SDE by 2 years and it is equal to 1yr Sr.SDE service .Then he has to serve as Sr.SDE for 4 years to get DE Promotion and so on. Policy It can be noticed that there is shortage of staff(JTO/SDE/DE) in some circles. Therefore, executives from distant circles are posted at very distant places from their hometown. Recreational/health/transport facilities may not be good in such remote places and hence people in such remote areas tend to go in depression and get suicidal tendencies. Also, local circle executives may not be willing to serve/work in such locations. To overcome this problem, to some extent, more number of TTAs must be recruited in such SSAs/Circles. Such TTAs can be promoted as JTO/SDE within few years. This may reduce the issue of posting of executives to Hard-Tenure circles within few years. Also, performance of BSNL will improve with availability of more local staff. 0

Policy The CPSU cadre hierarchy proposals by BSNL Management are not fully aligned with the recommendations of the Khan Committee. The change of designations up to AGM grade in line with designations of other CPSUs is a welcome move. But it is very much agonising that the proposals diluted very important recommendations of the Khan Committee. While Khan Committee recommended time-bound functinal promotions up to AGM level, the proposals restrict time-bound functinal promotions up to Sr SDE level only. All the Executives with E4 scale will not be promoted to AGM grade, only Sr SDEs with E4 scale will be given functinal promotion to AGM depending on the availability of posts. There is a lot of confusion in the proposals. The proposals say the present strength of AGMs is 5500 and another 1200 will be promoted to AGM. I do not think there are 1200 Sr SDEs working in BSNL. As per proposals, only Sr SDEs are eligible for promotion to AGM. When there are no ample no. of Sr SDEs, how will a sudden surge be in no. of executives in AGM grade? The proposal on promotion of Executives, who are drawing two or more higher scales than the substantive grade, is also ambiguous. The proposals say the Executives, who are in substantive grade and drawing two or more higher scales, shall be placed in the next higher grade immediately and subsequent grade will be considered after 2 years interval/immediately up to the scale he/she is presently placed. The proposal is so vague that it is not understood whether a JTO with E4 grade is considered for promotion to Chief Manager grade immediately or after two years of interval. It is very astonishing to hear from our great SNEA leaders that a JTO with E3 will be given promotion to SDE immediately and he/she will be promoted to Sr SDE after another 3 years. Nowhere in the proposals, it was mentioned. As the Management asked for the inputs from the Associations on the proposals, all of us should raise our voice against the proposals and demand to implement the Khan Committee recommendations without any deviation. An Executive with E2/E3/E4 scales shall be promoted to Deputy Manager/Senior Manager/Chief Manager-AGM. We should exhort our Associations to demand for implementation of Khan Committee recommendations on CPSU cadre hierarchy in toto. 1

Others Sir, seen the updated Seniority list no. 8 uploaded on 04/08/2016. Several SDEs who passed LDCE as SDE against previous vacancy year allotted in previous list 8 as PQ vacancy year. We have represented that when JTOs got CQ vacancy year then why SDEs got PQ vacancy year. As per SC decision if date of joining is seniority criteria then ok no matter, but CQ vacancy year may be allotted to such SDEs who passed CQ exam as SDE. But surprised to see that in such cases " CQ 07 SEN CANCELLED" mentioned in Remarks column of updated Seniority list no. 8 in all 124 candidates. Why? Whether our CQ exam 2007 cancelled? Where is cancellation letter? What are the charges for cancellaltion of our CQ exam 2007? It is very painful sir. Others In the present scenario due to various court cases, promotions from JTO to SDE and SDE to DE is not possible immediately. The only solution is one time placement in the cadre of SDE to all JTOs who are in E3 or above scale . Similarly all SDE who are in E5 or above scale may be placed as DE as one time measure . After completion of court cases the same may be regularised, if required . GS SNEA has already started the movement in this regard. Others In the adhoc DGM Promotion many of our officers who have got promotion were posted outside the parent circle. Some of these officers were posted outside the circles during the STS promotion also and spent more than 2 years and came back to parent circle. Again they were disturbed. Association should bring these issues to the administration. Also those officers who were not willing, should be allowed to decline. It is the matter of concern for everybody who have completed 55 years of age. Association should not be a silent spectator on this issue. It is the known fact that there is no binding in the TBP order that officers getting TBP should not dicline the normal promotion. This sort of promotion instead bringing cheer t brings torture and nuisance effect. Association should put an end to this sort of torture during the fag end of service of our officers 1

Organisational Pension, as per Pension Rules is calculated only on "LAST DRAWN PAY". When the pay is not drawn and paid to any person (retrospectively upon any revision), then it Pension revision does not arise. In case of any Central / State Govt Retiree, in case of any Pay revision on Pay Commission, on receiving orders conveying Table of Pay Scale(s) and their Revised ones on PRC recommendation, the following are the action: i) Pension Book of the Pensioner deposited to Pension Cell, will be entered with revised Pay as on the Date of Retirement, as per the PRC Order for implementation. ii) Pay as well as Pension, as the case may be and as per the letter, would be entered as due and drawn, in Pension Book and along with Net Arrears Payable. iii) Arrears would be credited to Bank A/c and Revised Pension would be paid thenceforth. This is the procedure in case of Retired Central / State Govt Servants. Whereas, in the case of BSNL Optees who have been taken for a ride to be cheated of any financial benefits as ulterior motive, recent letter of DoT on 78.2% IDA on 50% IDA merger (candidly having no mention at all on withdrawn 60:40 condition anywhere) mentions clearly that: Since such retirees from 2007 to 2013 are not drawn pay arrears on revision of pay on 78.2% case, the arrears of DCRG, Leave Encashment, Commutation, etc., cannot be paid. This is nothing but a clear cut case of selective and vindictive action biased against and towards all the BSNL Opted retirees, exclusively and explicitly. Happening of similar instance is literally impossible to any Central / State Govt Servants. This is exposing clearly that there is inherent animosity of denying any financial benefit payment to BSNL retirees. Further, if the pension paying authority fixed pension to BSNL retirees of 2007 to 2013, w/o drawing and paying arrears of pay and thence only the newly fixed revised Pension, (where fixing of pension itself is inadmissible as per Pension Rules), such act has to be treated as violation of Pension Rules. This can be challenged as wilful and fradulant deviation of Pension Rules of GoI which can be directly sued in the Court of Law. Freak and deliberate act of DoT to cheat BSNL Opted Retirees in particular against the commitment given in Presidential Order given to us at the time of absorption. If this order is implemented, it is to be construed that DoT (GoI) is bent upon denying financial benefits to BSNL Optees cum retirees at any time which is nothing but cheating. In such case, everyone of us should fight for declaring our BSNL Option to null and void on account of infringement of Presidential Order committed and given to us at the time of BSNL Absorption. Associations / Unions to wake up to prevent this dubious act to deny BSNL Optee cum retirees and demand in Unison for cancellation of order (ii) Publication of orders of withdrawal of 60:40 condition (iii) Pay Arrears of pay right from 2007 to serving as well as retirees, the pay, pension and any other resulting benefit amount of Arrears. Without this, we have to directly call for withdrawal of BSNL Option only. 1

Organisational PRC suggestions submitted are vague and not mentioned about financial resources to justify PRC payout. No doubt, like last time, this PRC also concerned about affordability of PSU to bear the Pay revision burden. That needs to be highlighted. Else this report ll get deaf ears. 0

Organisational Where is the source of funding for PRC. That was not mentioned in PRC suggestion report. PRC committee is much concerned about PRC implementation implications on financial health of the PSU rather than listening other things. Policy sir, C.O. released an order recently about refusal of decline to promotion in many grounds. Some cases have been accepted and others refused. As a vibrant trade union we should not accept these kind of partition attitude.All officers promoted are in fag end of their carrier and a right way of respecting their service is only re-posting them to their home state and let them retire happily.Otherwise we in a way , it seems we are forcing them to go on VRS, WHICH IS NOT CORRECT for promotion policy itself.. Hence take necessary steps to stop this REFUSAL category. 2
