Finally Justice prevails for VRS opted Executives and Employees facing fake caste allegations: AGM Estt BSNL CO issued orders for release of all the pending due benefits of the Executives and Employees who have opted for VRS 2019 and whose retirement benefits were kept on hold by MH Circle on basis of fake caste compliant. This is a landmark triumph ending an agonizing seven year ordeal wherein justice prevailed for affected BSNL Executives and Employees from Maharashtra Circle who opted for the Voluntary Retirement Scheme 2019.

With this order, lakhs of rupees which were due on the date of VRS 2019 and forcefully and illegally kept on hold by BSNL MH Circle are released giving a great and much awaited financial relief of these Executives/Employees and their family members.

Though the fake caste complaint was received against all ST Category Executives/Employees of MH Circle, out of nearly 1200 such Executives/Employees, majority could establish authenticity and about 200 could not establish it due to non-availability of caste records of their forefathers before 1967.   Meantime, VRS 2019 was announced and to encourage more participation in VRS, then CGM MH Circle personally assured employees in a special meeting that caste complaints would not hinder VRS acceptance or the release of retirement benefits.

Accordingly after getting Vigilance Clearance the VRS of all such executives and employees were accepted. But thereafter, certain officers in MH Circle management misused their powers in twisting this decision and illegally kept on hold the due benefits of the VRS 2019 in respect of Executives and Employees facing allegations of fake caste.

This issue was initially raised by SNEA MH and with keen persuasion, the provisional pension of all these Executives/ Employees was first granted for a temporary period of six months and then extended for further six months and then this provisional pension was regularised but other retirement benefits continued to be kept on hold.

In an extremely biased approach, MH Circle issued charge sheets to these Executives/Employees and their VC was kept on hold at a later stage and quoting non-clearance of current VC, the benefits were denied, even after certain positive directions by BSNL Corporate office.

Since then this issue was raised and continuously pursued by SNEA/SNPWA with CGMT MH, CCA MH, Director HR, CMD BSNL, Member Services, Secretary DoT, National Commission for ST, Parliamentary Committee, Chief Minister of Maharashtra and Honourable Minister of Communications and we have successfully established demand to release due retirement benefits on basis of DoPT/DoT guidelines and how the decision of MH Circle was wrong, how VC was clear on date of VRS and how MH Circle has issued chargesheet after three years of retirement and how on fabricated basis the retirement benefits are kept on hold.

For the last seven years, Maharashtra Circle was misleading BSNL Corporate Office on this issue and unfortunately BSNL management also joined hands with MH Circle to keep on hold the due retirement benefits.

Many affected individuals have challenged the chargesheet and termination in CAT Mumbai, Aurangabad and Nagpur, HC Mumbai and exposed biased stand of Management and majority of these cases were advocated by Adv R T Divate, Legal Advisor, SNPWA MH.

Even after the defeat of MH Circle in about all these court cases at CAT, High Court, these officers dragged this matter to the Supreme Court by filing an appeal against HC Judgement and recently the Supreme Court also rejected the appeal by BSNL and this has given way forward for resolution of the hurdles in releasing pensionary benefits. 

In the overall process, Shri. G.L. Jogi, GS SNPWA CHQ, played a vital role by standing behind these affected Executives like a rock and used every possible platform to raise this issue asking for justice to the affected Executives and Employees. Shri. D.M. Gaikar, CS SNPWA MH, Shri. Samir Khare as then CS SNEA MH and Shri. Tejas Tadasre, CS SNEA MH also have taken up the issues at MH Circle, CCA MH and put forward this demand.

Shri. M. S. Adasul, GS SNEA has pursued this issue at all levels starting with during VRS 2019 with persuasion with MH Circle, CCA MH as then CS SNEA MH and thereafter at BSNL Corporate office and DoT till the issue is resolved in favour of affected Executives and Employees.

At the crucial stage, when the issue has reached at the level of Secretary DoT and Honourable Minister of Communications, SNEA could establish that in violation of DoPT and DoT guidelines, BSNL Management has forcefully kept on hold the retirement benefits and we could establish how these Executives/Employees are being harassed in fabricated manner by issuing charge sheets at later stage and thereby illegally withholding VCs and applying it retrospective effect from date of approval of VRS. 

With intervention by Respected Shri. Jyotiraditya Scindia ji, Minister of Communications, the issue moved further with high level correspondence between MoC and CM Maharashtra and finally matter was decided by Secretary DoT with clear directions to BSNL to release all the retirement benefits of all affected Executives and Employees. 

Thus, which prolonged and sustained efforts and continuous persuasion at all levels by SNEA and SNPWA, finally justice prevails for the affected Executives & Employees opted for VRS 2019 as now after wait of seven years the Gratuity amount is released by CCA MH Circle with a day of this order by BSNL CO and action for releasing Ex-Gracia amount has been initiated.

SNEA conveys sincere thanks to Shri Jyotiraditya Scindia ji, Minister of Communications, Shri. Devendra Fadnavis ji, Chief Minister Maharashtra State, Shri. Amit Agarwal, Secretary DoT, Shri. Manish Lodha, DDG Estt DoT and all other concerned officers for taking final call and giving justice to about 150 affected Executives and Employees.

SNEA conveys special thanks and gratitude to Shri. G.L. Jogi, GS SNPWA CHQ, Shri. D. M. Gaikar, CS SNPWA MH, Shri. Samir Khare, then CS SNEA MH and Shri. Tejas Tadasre, CS SNEA MH, Adv R.T. This outcome stands as a powerful testament to a timeless truth: Justice may be delayed by biased actions, but it cannot be denied and only required is tireless persuasion with documentary support and sincere efforts.

Update on emergency online Meeting of AUAB CHQ: The emergent online meeting of the AUAB was held on 08/08/2026 to review the agitation programmes conducted in July against the Uttarakhand Pilot Project.

The meeting expressed concern over the restructuring of Circle and BA administrations being initiated by BSNL Management in some Circles without discussions with the unions and associations.

The meeting also discussed the 3rd PRC, the need to exert greater pressure on the DoT and the Government for its early approval, and the strengthening of the AUAB. After detailed discussion, the following decisions were taken:

· Circle level AUAB meetings will be organised to intensify the struggle for the 3rd PRC and against the Uttarakhand Pilot Project.

· A letter will be addressed to the Minister of Communications and the DoT, highlighting the adverse impact of the proposed restructuring of Circle and BA administrations.

· Regarding the repeated appeals from BDM for the formation of a JAC comprising BDM and AUAB, the meeting unanimously decided to strengthen unity under the recognised banner of AUAB for the 3rd PRC and against arbitrary restructuring. A reply will be given to the BDM leadership explaining the need for joint struggles under the AUAB banner. BDM will also be invited to attend an AUAB meeting to discuss future joint programmes. The Chairman and Convener of BDM will be requested to re-join the AUAB and strengthen the united struggle.

· The meeting also decided to await the response of BSNL Management on the restructuring proposal, as assured by the Director (HR) and CMD BSNL.

·  In this connection, a physical meeting of the AUAB will be held on 21/08/2026 to decide the future course of action on the 3rd PRC and restructuring of the Circle and BA administration.

Update on JTO to SDE Promotion Court Case at CAT Chandigarh: The court case challenging seniority in JTO to SDE promotion Court case in CAT Chandigarh was listed for final hearing today i.e. 12/08/2026.

Shri Pawan Meena Jt Sec West SNEA CHQ and Shri Pankaj Chopra CS SNEA HP were present in the court.

This case was listed at serial number 35. But after completing hearing up to case No. 24, the Court adjourned for the day.

As such, again due to paucity of time the case is not heard today also. Earlier, the next date of hearing was given as on 14/10/2026, but now as per request it is modified and accordingly next hearing will be held on 09/09/2026.

Update on court case staying AGM to DGM T Regular as well as Adhoc Promotions: The court case filed by Shri Amarjeet against BSNL in CAT Chandigarh on seniority issue thereby granting stay on AGM to DGM Telecom Regular as well as Adhoc Promotions, was listed for hearing today i.e. 03/08/2026 at Sr No 47. But the same was not heard due to the paucity of time. On special request of BSNL advocate for posting this case for early hearing, the case is now posted for the next hearing on 27/08/2026.

After detailed hearing the case on 02/07/2026 and an excellent presentation by the Senior advocate of BSNL for more than one hour with detailed submission in case and request to allow BSNL to go ahead with DGM promotions subject to outcome of the case as Administration is facing difficulties. BSNL also submitted that though the applicant is not eligible for promotions as of now, if desired by Hon. CAT one post can be reserved for applicant. But advocate of applicant submitted that some more applications are submitted in the case and the same needs to be heard and issues raised by applicants need to be given consideration. In the next hearing which was held on 27/07/2026, advocate for applicant submitted the documents as directed by Hon CAT in the last hearing and the case was posted for hearing on 03/08/2026. Now the next date is also given with a short time and it enhances the chances of some concrete decision in this case.

We are hopeful that in the next hearing Hon CAT will take decision on the case as final submission from both the sides is as good as completed and if not at least decision on request of BSNL to go ahead with DGM Telecom Regular Promotions will be given consideration.

Update on E5 to E7 Court case at PCAT Delhi: The hearing in court case for enhancement of E5 Pay Scales E7 filed by SNEA at PCAT Delhi was held on 30/07/2026. SNEA has filed the reply opposing MA filed by AIGETOA as it is attempting to delay hearing in Original application by SNEA filed before four years i.e. in 2022. The advocate of AIGETOA asked for time to go through the submission by SNEA and respond it. Now the case is listed for next hearing on 12/11/2026.

With indefinite seat out call by AUAB Uttarakhand Circle and the countrywide struggle with Black badges on 24/07/2026 and Lunch Hour Demonstration on 30/07/2026 in support of agitating Uttarakhand workforce against the Uttarakhand Pilot Project has created tremendous pressure on the BSNL Management. Following a communication from the Corporate Office, CGM Uttarakhand, held fresh rounds of discussions with the AUAB Uttarakhand Circle on 31/07/2026.

Based on the written assurances given by the CGM, Uttarakhand AUAB Uttarakhand Circle has deferred their agitational programme.

Arvind Pal Dahiya, JSC and Ms Anu Agarwal, CS SNEA BSNL CO gave warmth and congratulated Shri H.S. Bisht,  on taking over the charge of CGM BW with additional charge  of CGM EW BSNL CO.

We conveyed greetings and best wishes for his success in the new and promotional assignment as CGM BW with additional charge of  CGM EW BSNL CO.

In reciprocation Shri H.S. Bisht, CGM BW/EW conveyed thanks to the SNEA delegation and assured total support for issues related to executives of the Civil as well as Electrical wing.  He added that he is aware about the  hardship faced by the Executives in both the wings and will try to extend all possible help.

We requested for early consideration of representations received against transfers in SDE Civil as well as Electrical wing promotions and also submitted the details of possible changes without any disturbing to  office working. He assured us to look into it and take the status of the cases and see that the representations are given consideration at the earliest.

We also have detailed discussions on further promotional aspects by overcoming the issues in different court cases on  EE Civil/Elect promotions and the need for action on part of Management to take concrete decisions to resolve the long pending dispute.

We submitted that  the early decision on this issue will give at least one  promotion during the left out services of these Executives. CGM BW/EW assured for positive consideration so as to go ahead with promotions.

We also discussed the hardship and difficulties faced by the Executives in the Civil and Electrical wing and requested for certain initiatives from his side to reduce the hardship in office working. Shri Bisht assured for all possible steps after analysing issues and requested us to give feedback and suggestion and assured for its resolution to possible extent

in the larger interest of BSNL and its executives.

In conclusion, we assured full cooperation and support from SNEA to him for justice to the affected executives of Electrical and Civil wing.

Update on hearing by Supreme Court on SLP by BSNL for AO to CAO Promotions: The SLP  filed by BSNL on AO to CAO Court case was heard in Supreme Court on 24/07/2026.  Honourable Supreme Court did not pass any specific order but noted observations that BSNL or other affected parties are free to approach  Chief Justice of High Court for early decision on pending writ petition to fill 440 vacant posts as the interest of administration is adversely affected  since eligible officers cannot be promoted for consequent promotions and disposed off the SLP filed by BSNL. Accordingly, BSNL Management will take up case with Chief Justice of High Court for early decision in the pending writ petition.   ORDER <<<>>

Overwhelming Response to the Nationwide Lunch Hour Demonstration call in Protest of Uttarakhand Circle Restructuring Proposal: The nationwide call given by the All Unions and Associations of BSNL (AUAB) for Lunch Hour Demonstrations against the proposed Uttarakhand Pilot Project under the restructuring scheme received an overwhelming response from the BSNL workforce across the country.

Massive Lunch Hour Demonstrations were successfully organized throughout India on 31/07/2026 with enthusiastic participation from Executives and Non-Executives.

The nationwide protests sent a strong and unequivocal message against the unilateral and anti-BSNL restructuring proposal being implemented through the Uttarakhand Pilot Project.

Although the BSNL Management initially remained indifferent and avoided meaningful dialogue with AUAB, the unprecedented response from employees across the country in general and  the strong and united movement in Uttarakhand Circle in particular, compelled the Management to initiate discussions with the AUAB leadership both at the Corporate Office and in Uttarakhand Circle.

The Executives and Non-Executives have clearly realized that the proposed Uttarakhand Pilot Project is not merely a Circle-specific issue. There is growing concern that similar restructuring may soon be extended to other Circles, as preparatory work has reportedly already commenced in some Circles and at the Corporate Office. Such a move is likely to adversely affect a large number of BSNL employees across the country.

The massive participation in the Nationwide demonstrations reflected the growing concern and resentment among BSNL employees against the proposed restructuring plan. Thousands of Executives and Non-Executives from Corporate Office, Circle Offices, Business Areas, and Operational Areas actively participated in the demonstrations.

AUAB Circle and District leaders across the country played a proactive role in organizing the programmes and addressed the gatherings, highlighting the unilateral approach adopted by the Management without adequately assessing the practical operational requirements. AUAB leaders at all levels  appealed to the employees to remain united and intensify the movement, if required, to safeguard the interests of BSNL and its workforce.

Meanwhile, the BSNL workforce in Uttarakhand Circle continued its historic Full-Day Dharna for the fourth consecutive day, demonstrating exemplary unity, determination, and commitment. This remarkable show of solidarity by Executives and Non-Executives under the banner of AUAB has created significant pressure on the Circle Management. The CGM, Uttarakhand Circle, has made repeated appeals and initiated detailed discussions with the AUAB leadership to resolve the issues through dialogue.

At BSNL Corporate Office, Eastern Court, New Delhi, a massive Lunch Hour Demonstration was organized with enthusiastic participation from Executives and Non-Executives. The gathering was addressed by the General Secretaries and Representatives of the constituent Unions and Associations of AUAB, who strongly condemned the proposed restructuring initiative and reiterated their commitment to protecting the interests of BSNL and its employees.

AUAB CHQ conveys its heartfelt congratulations and sincere appreciation to all members, Circle/District leaders, and the leadership of all constituent Unions and Associations for making the nationwide Lunch Hour Demonstrations a grand success.

AUAB also salutes to the strongly united Executives and Employees of Uttarakhand Circle and also expresses its sincere gratitude to entire BSNL workforce for extending unwavering solidarity and support to the employees of Uttarakhand Circle.

The overwhelming participation from every nook and corner of the country has once again reaffirmed the unparalleled unity of the BSNL workforce under the banner of AUAB. This united voice against the anti-BSNL restructuring proposal has sent a powerful message to the BSNL Management as well as the Government of India.

AUAB continues the agitational Call with LHD all over India:  Online meeting of unions and associations held on 30/07/2026 to discuss the Pilot Project issue of Uttarakhand. The agitating members and Circle Secretaries of Uttarakhand have participated in the meeting. After a lengthy discussion on the issue the leaders decided to request the management to roll back the Pilot Project in Uttarakhand immediately and also requested the Management to call the all leaders of unions and associations to discuss the issue.

All Unions and Associations unanimously decided to make the lunch hour demonstration at all levels on 31/07/2026 by opposing the Pilot project in Uttarakhand and also requested the Circle/District Secretaries and activists to make the twitter campaign a big success on 03/08/2026.
